Medical Device Group Sets New Advertising Guidelines

(BSX) Johnson& Johnson (JNJ) and Medtronic Inc. (MDT) on Thursday outlined a set ofadvertising principles. The move comes after some Senate lawmakers threatened to push legislation totighten device advertising regulation which is currently split between theFederal Trade Commission and the Food and Drug Administration. The FDA generallyhas jurisdiction over devices that are implanted inside the body such as heartstents and artificial knees and hips. However advertising rules for devices aren’t as strict as those for drugadvertisements which require companies to submit ads to the FDA for reviewbefore being disseminated and outline how risks and benefits of a drug can beadvertised. Congress would need to enact legislation to give the FDA authorityto regulate device advertising in a manner similar to drug products.

The Home Rule Charter requires that the city post legal notices in Philadelphia’s three largest-circulation paid daily newspapers. Currently those are The Inquirer (with a weekday circulation of about 334000) the Philadelphia Daily News (107000) and the Legal Intelligencer (14000). The 125000-circulation Metro is free.
